Kevin B. Rack has more than thirty years of experience in advanced estate planning and in the administration of trusts and probate estates. Recognized by U.S. News and World Report as among the “Best Lawyers in America” in the practice areas of Trusts & Estates and Trust & Estate Litigation since 2009, Mr. Rack serves as legal and tax counsel to clients in developing and implementing complex wealth preservation and asset protection strategies, as well as the preparation of revocable trusts, wills and related instruments for clients requiring more essential estate planning. Mr. Rack is also experienced in the challenges of litigation and mediation of disputes among (blended) family members and fiduciaries which involve estates, trusts and powers of attorney.
Mr. Rack was one of the few early practitioners of elder law, in which the attorney is focused on the representation of seniors, or their family members and fiduciaries, in legal matters affecting the elderly. These matters involve issues as varied as Medicaid eligibility planning for long term care, special needs trusts, marital agreements, and petitions for appointment of family members as conservator. The benefit of his years of experience in this practice area is reflected in Chapter 1, “The Elder Law Practice,” which he authored for publication in Elder Law in Virginia, Third Edition (2017) published by the Virginia CLE Foundation.
Mr. Rack also has been selected by his peers as one of Virginia’s “Legal Elite” in Virginia Business magazine in the categories of “Taxes / Estates / Trusts / Elder Law,” and has been recognized by Coastal Virginia magazine as among the “Best Lawyers in Virginia” for trusts and estates.
Mr. Rack is a Past President of the Hampton Roads Estate Planning Council and a Past Chairman of the Elder Law Section of the Virginia Bar Association.
